BCI Burke Company, LLC and its subsidiaries and affiliates (“BCI Burke” or “we,” “our,” or “us”) are committed to protecting your privacy. This Privacy Policy (“Privacy Policy”) describes the types of information that we gather from you, including when you use our websites, including without limitation (collectively, the “Sites”), or that you may provide to us through means other than the Sites, as well as how and why we collect, store, use, and share your personal information.  It also explains your rights in relation to your personal information and how to contact us or other authorities in the event you have a complaint or request.  Any personal information that you provide to us will only be used in accordance with this Privacy Policy.

By providing information to us, including without limitation, by accessing or using any of the Sites or communicating with us (such as by phone, email, our chat features or other correspondence or communication) (“Interacting”) with us regarding our business, products or services, you agree to be bound by this Privacy Policy.

We reserve the right to update or modify this Privacy Policy from time to time, so we encourage you to review it periodically. We will notify you of any changes by revising the “Last Updated” date at the top of this Privacy Policy. In all cases, your continued Interaction with us, our Sites or our products and services constitutes consideration and your binding acceptance to any such changes. We encourage you to review this Privacy Policy regularly to ensure that you are familiar with our current practices.

We collect and use certain information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“personal information”). When we do so we may be subject to various laws in the United States, including state consumer data privacy laws, such as the California Consumer Privacy Act of 2018, as amended (the “CCPA”) and the UK General Data Protection Regulation and Data Protection Act 2018 (DPA 2018), both of which apply to the United Kingdom (collectively the “UK GDPR”).  We are responsible as a “controller” or similar entity with respect to that personal information for the purposes of the UK GDPR and state consumer laws in the U.S., other than the CCPA.  With respect to the CCPA, we are responsible for your personal information as a “business” pursuant to the CCPA.

We also may collect aggregated data, such as demographic or statistical information for our internal business purposes, such as market research on brands and products, marketing campaigns, and advertising.  Such information is not personal information as it does not directly or indirectly identify you.

If you do not provide personal information that is required to provide products or services to you, it may delay or prevent us from providing products or services to you.

 

2. How Your Personal Information is Collected. We collect personal information from the following categories of sources:

  • You, directly in person, by telephone, text, or email and/or via our Sites
  • Publicly accessible sources (e.g., social media sites and other publicly available web sites)
  • Directly from a third party (e.g., credit reporting agencies, or customer due diligence providers)
  • Vendors and other third parties

How We Use Cookies. When you visit any of our Sites we may store information about your session and assign you one or more cookies.  We use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a webpage server, and if you return to the same Site the cookie may be read.  Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page of a Site. For example, if you personalize our pages, or register with one of our Sites or services, a cookie helps us to recall your specific information on subsequent visits. This simplifies the process of recording your Personal Information, such as billing addresses, shipping addresses, and so on. The Sites use both session cookies, which terminate when a user closes his or her browser, and persistent cookies, which remain on the user’s device until they expire or are manually deleted. The Services also contain coding from our business and technology partners which generates third party cookies. Third party cookies allow our business and technology partners to store non-identifying Personal Information they can access when you visit this or other websites. Accepting a cookie from a web or device browser does not give us access to any Personal Information. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of the features on the Sites.

The cookies that we place on your browser or device may also allow us to collect information about your online activity after you leave our Sites. Just like any other usage information we collect, this information allows us to improve the Sites and customize your online experience, and otherwise as described in this Privacy Policy. 5. UK GDPR Subjects: Promotional Communications. We may use your personal information to send you updates (by email, telephone, or post) about our products and/or services, including exclusive offers, promotions.

We have a legitimate interest in processing your personal information for promotional purposes (see above “How and why we use your personal information”). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

We will always never sell or share your personal information with other organizations for marketing purposes.

You have the right to opt-out of receiving promotional communications at any time by:

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers relating to ensure they can only use your personal information to provide services to us and to you. We may also share personal information with external auditors, e.g., in relation to ISO or other accreditation and the audit of our accounts.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.

We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

We will not share your personal information with any other third party.

 

7. Personal Information We Sold or Shared. Other than with respect to the business purposes discussed above, we do not sell or share your personal information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale or sharing.

9. How Long Your Personal Information Will Be Kept. We will keep your personal information while you have an account with us or while we are providing products and/or services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf
  • To show that we treated you fairly –or–
  • To keep records required by law

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information.

When it is no longer necessary to retain your personal information, we will delete or anonymize it.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records –and–

  • Direct third parties to whom the business has sold or shared your personal information to delete your personal information unless this proves impossible or involves disproportionate effort

  • Comply with an existing legal obligation, or enable the exercise of a legal right (such as free speech) –or–

Right of Correction

If we maintain inaccurate personal information about you, you have the right to request us to correct that inaccurate personal information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

Protection Against Retaliation

You have the right to not be retaliated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

  • Deny goods or services to you
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties
  • Provide a different level or quality of goods or services to you –or–
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services

Please note that we may charge a different price or rate or provide a different level or quality of products and/or services to you, if that difference is reasonably related to the value provided to our business by your personal information. We may also offer loyalty, rewards, premium features, discounts, or club card programs consistent with these rights or payments as compensation, for the collection of personal information, the sale of personal information, or the retention of personal information.

  • Please note that you may only make a CCPA-related data access or data portability disclosure request twice within a 12-month period.
  • If you choose to contact us directly by email or phone or otherwise in writing, you will need to provide us with:
  • Enough information to identify you (e.g., your full name, address and customer or matter reference number, if available)
  • Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill) –and–
  • A description of what right you want to exercise and the information to which your request relates
  • We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person's behalf.
  • Any personal information we collect from you to verify your identity in connection with you request will be used solely for the purposes of verification.

 

13. UK GDPR Data Subjects: Where Your Personal Information is Held. Information may be held at our offices and those of our [group companies], third-party agencies, service providers, representatives and agents as described above (see above: “Who We Share Your Personal Information with”).

14. UK GDPR Data Subjects: Transferring Your Personal Information Out of the United Kingdom. To deliver services to you, it is sometimes necessary for us to share your personal information outside the United Kingdom, such as to our affiliates, service providers, or to you, in each case that may be outside of the UK.  Such transfers may include transfers to the countries such as the United States that do not have the same data protection laws as the United Kingdom. 15. UK GDPR Data Subjects:  Employment Applicants.  If you apply for a position with BCI Burke or any of its affiliates, including at any location in the UK, BCI Burke will collect certain personal data as part of the application process, including any information you provide by Interacting with BCI Burke. This information will be used to decide whether you are applying for employment. Processing this information is legally permitted where necessary to take steps at your request before entering into a contract with you, if any, and in some cases necessary for our legitimate interests in selecting the most suitable candidate for a role and complying with legal obligations (for example, verifying that you have the necessary work permit to take up employment in the country of your choice).

 

16. Third Party Websites.  Our Sites may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such websites and such websites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

 

17. Children and Privacy.  Our Sites are not directed to persons under the age of 18.  If you are not 18 years or older, do not use our Sites. We do not knowingly collect personal information from persons under the age of 13.  If you believe that BCI Burke or any of its affiliates have collected personal information from anyone under the age of 13, please contact BCI Burke immediately.

 

18. Keeping Your Personal Information Secure. We have appropriate security measures in place that are designed to prevent personal information from being accidentally lost or used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality.  We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.
